Your privacy is important to UrFilez. Please read the UrFilez Privacy Policy below to learn more about the information collected, how UrFilez uses and shares this information, and your options to control how information is used or shared.

This privacy policy ("Privacy Policy") applies to UrFilez SPC and its affiliates ("UrFilez," "we," "us," or "our") with respect to our operations in Bahrain or other countries for the Internet radio services that we offer through our website located at www.UrFilez.com (the “Site”), supported mobile devices, consumer electronics devices and other mechanisms (collectively, the "UrFilez Services"). The purpose of this Privacy Policy is to inform you about information that UrFilez may collect, how UrFilez uses that information, and how you can control how that information is used or shared. We want to highlight some key issues to keep in mind about our data collection and use practices. For information about your obligations and use of UrFilez Services, please see our Terms of Use.

We will continue to evaluate this Privacy Policy against new technologies, business practices, and our users’ needs, and may make changes to the Privacy Policy accordingly. Please check this page periodically for updates. If we make any material changes to this Privacy Policy, we will post the updated Privacy Policy here and notify you by e-mail or by means of a notice on our website's home page.

The types of information we collect

We have several areas where you can submit information to us, and we also have features that automatically collect information from users of the UrFilez Services and visitors to our Site.

Information you give us:

To enable you to enjoy certain features of the UrFilez Services, we may collect certain types of information during your interactions with the UrFilez Services. For example, we may collect information when you:

1. Register to use the UrFilez Services;
2. Post comments on UrFilez pages or use other community and social networking features that are part of the UrFilez Services;
3. Participate in polls, contests, or other features of the UrFilez Services; and
4. Sign up to receive e-mail newsletters.

When you register, we ask you to provide your e-mail address, as well as a password for your account. We will not sell or give your e-mail address to other companies for their marketing purposes.

If you choose to subscribe to fee-based portions of the UrFilez Services, you will also be asked to provide your name, credit card information, billing address and phone number. When you contact us by e-mail, we retain the e-mails that you send to us.

Information we receive from third parties:

We may receive information about you from third parties and store it in our databases with other information (including personally identifiable information) that you provide to us. Some examples of these third parties are listed below:

1. Service partners and advertisers that make features available through the UrFilez Services;
2. Service partners through whom we allow registered users to access UrFilez Services;
3. Marketing companies that create professional marketing lists or sell other marketing data;
4. Other websites or applications that you have registered to use, or that people you know have registered to use, when we allow those websites or applications to interact through UrFilez Services to provide personalized services to you. In some cases, those websites or applications may automatically provide us with information about you to facilitate personalization unless you use the controls available on those websites or applications to opt-out of such sharing.

UrFilez is not responsible for, and will assume no liability, if a business partner or other entity collects, uses, or shares any information about you in violation of its own privacy policy or applicable law.

Information that we receive from other users:

We may collect information about you from people who have stored information about you when they elect to use our social networking or community features, or when they enable connectivity with another website or application where they have stored such information. For instance, your friends may have stored information about you in places such as friends’ lists, address books, or photos on our site and other sites with which UrFilez interacts.

We may also collect your e-mail address when people you know share a station with you, but we will not add your name to any of our mailing lists as a result of this feature.

Automatic Data Collection:

Copyright Tracking:

UrFilez incorporates software that is designed to protect the copyrights associated with the tracks you listen to and to ensure that artists and copyright owners receive applicable royalties. This software identifies and counts the songs you have accessed so that we can report on listening in the aggregate to music licensing agencies. These reports do not contain individual user data.

Service partners:

When you access the UrFilez Services through a service partner, we may add select aspects of your registration information (such as your e-mail address and/or device ID) so that we can recognize which of our Partners or other sign-in pages to send you to when you log on to the UrFilez Services.

Tracking technology:

We use what are commonly called "cookies," a small data string our server writes to your hard drive, and other tracking technology (such as Flash Persistent Storage) to help us manage and track your interaction with UrFilez Services. These technologies collect non-personally identifiable information to improve UrFilez Services to keep count of return visits to our site or our advertisers' or partners' sites, collect and report on aggregate statistical information, save your password and login information, and/or display advertising or content based on your interests. We may also capture other data such as search criteria and results, date, time, connection speed and IP addresses. Third parties whose products or services are accessible or advertised via the UrFilez Services may also use cookies, and we advise you to check their privacy policies for information about their cookies and other privacy practices.

We also use third party advertising companies to deliver ads to you when you use the UrFilez Services. In the course of providing this service, our third-party advertising companies may place or recognize a unique cookie on your device which collects non-personally identifiable information about your visits to UrFilez, such as the number of times you have viewed an ad (but not your name, address, e-mail address, telephone number or other personally identifiable information).

How we use the information we collect

We use the information that we collect and you provide about yourself for the following purposes:

1. To customize and personalize your UrFilez experience through advertising and other content.
2. To enhance the user experience in our network of sites. We use tracking information to determine how well each page and station performs overall based on aggregate listener demographics and traffic patterns to those pages and stations. This helps us continue to build a better service for you.
3. To fulfill your requests for certain products and services, such as sending out electronic newsletters and enabling you to participate in and renew paid services, polls, contests, and message boards.
4. To send you information that you agreed to receive about topics that we think will be of interest to you.
5. To alert you to UrFilez Services' latest developments and features.

We also may use and share non-personally identifiable information. The use and disclosure of such information is not subject to any restrictions under this Privacy Policy. Additionally, we may de-identify personally identifiable information and share it in a de-identified or aggregated form with third parties, advertisers and/or business partners in order to analyze site usage, improve the UrFilez Services and your user experience, or for other similar purposes.

How the information we collect is shared

We will make your personally identifiable information available to other companies, websites, applications or people in the circumstances listed below:

1. When you provide information in the course of your use of the UrFilez Services by participating in community and social networking features such as forums, station sharing, user opinions and reviews, or other forms of public communication and interaction. Any information that you post in our community and social networking features is available to members of the public.
2. When you elect to allow us to share information at the time that you register with us or provide us with the information, or through a subsequent affirmative election.
3. When we hire or partner with third parties to provide specialized services on our behalf, such as credit card processing, sweepstakes management and prize fulfillment, data processing, customer/support services and special products or services that we choose to make available to our registered users.
4. When you search for artists or listen to stations via the Services. Information about the artists, songs, and stations you have created or listened to may be made publically available.
5. When we jointly offer certain features or services with third parties, such as service partners that make features available through the UrFilez Services, business partners through whom we allow registered users to access UrFilez Services, advertisers, or marketing companies. When you use these features or services, you grant us permission to pass your UrFilez registration information back to that service partner. Their use of your information is subject to their applicable privacy policies.
6. When we work with a third party to provide personalization to the UrFilez Services through connectivity to another website or application. We may also share your information with a third party when we jointly offer a service or a feature with that third party, such as connectivity with other websites.
7. If you unsubscribe for a mailing that we send to you on behalf of a third party, we may share your removal instructions with the third party so that your e-mail address may be added to that company's list of people to whom they will not send e-mails directly.
8. In connection with a merger with another entity, or in the event of a transfer of all or some of our assets.
9. When we have a good faith belief that we are required to do so by law or in response to a law enforcement agency's request, or in a situation where disclosing your personal information is necessary to identify, contact or bring legal action against someone who may be causing injury to UrFilez, our users or members of the public.

How we protect your information

We have implemented commercially reasonable physical and electronic security measures to protect against the loss, misuse, and alteration of your personally identifiable information. Despite our best efforts, however, no security measures are perfect or impenetrable.

You have significant control over the information that is shared with other UrFilez users and the public through the privacy settings for your profile.

To opt-out of newsletters, promotional or marketing correspondence: Send an e-mail to support@UrFilez.com or follow the opt-out instructions provided in such correspondence. If you use more than one e-mail address, then send your opt-out e-mail from each of your e-mail addresses.

Your election not to receive newsletters, promotional and marketing correspondence, and other notices from us will not preclude us (including our employees, contractors, agents and other representatives) (a) from corresponding with you, by e-mail or otherwise, regarding your existing or past relationship with us, or (b) from accessing and viewing your personal information in the course of maintaining and improving the UrFilez Services.

UrFilez™ Mobile Services Terms and Conditions of Use

These Mobile Terms and Conditions of Use (the "Mobile Terms") are a legally binding agreement between you and UrFilez S.P.C. and its affiliates (“UrFilez,” “we,” “us” or “our”), governing your use of UrFilez’s Mobile Application and the streaming music and content services (collectively, the “Mobile Services”). They are in addition to the UrFilez Terms and Conditions of Use and the UrFilez Privacy Policy, which are incorporated herein by reference and also apply to your use of the Mobile Services. You can view these Mobile Terms, the UrFilez Terms and Conditions of Use and the UrFilez Privacy Policy at www.UrFilez.com.

IN ORDER FOR YOU TO HAVE ACCESS TO THE MOBILE SERVICES, THESE MOBILE TERMS MUST BE ACCEPTED BY YOU WITHOUT ANY MODIFICATIONS, ADDITIONS OR DELETIONS. BY USING OR SUBSCRIBING TO THE MOBILE SERVICES, YOU ACCEPT AND AGREE TO THE TERMS AND CONDITIONS OF THESE MOBILE TERMS. IF YOU DO NOT AGREE TO THESE MOBILE TERMS, YOU ARE NOT AUTHORIZED TO USE THE MOBILE SERVICES. YOU MAY BE DENIED ACCESS TO THE MOBILE SERVICES, WITH OR WITHOUT PRIOR NOTICE TO YOU, FOR NONCOMPLIANCE WITH ANY PROVISION OF THESE MOBILE TERMS.

UrFilez reserves the right, at its sole discretion, to change, modify, add or remove portions of these Mobile Terms at any time. Changes will be communicated to you by us posting the new version of the Mobile Terms on the UrFilez website. It is your responsibility to check the website for such postings from time to time. You may also be asked to reacknowledge and reaccept the Mobile Terms following any material changes. Your continued use of the Mobile Services following the posting or other notice of changes to the Mobile Terms will constitute your acceptance of such changes.

1. Registration
To use any aspect of the Mobile Services, you may be required to register and provide certain information, including your name, a password, your mobile telephone number and a valid e-mail address (the “Account Information”). You agree to provide accurate Account Information and to update your Account Information as necessary to keep it accurate. You agree that UrFilez has a right to collect and use your Account Information in accordance with its Privacy Policy. By providing your e-mail address, you consent to our using the e-mail address to send you service-related notices, including among other things notices required by law, in lieu of postal mail. You may not opt out of service-related e-mails. We may also use your e-mail address or your mobile telephone number to send you other messages, including information about UrFilez and special offers. You may opt out of such e-mail or mobile text messages by sending an e-mail to support@UrFilez.com. Opting out may prevent you from receiving messages regarding UrFilez or special offers.

2. Account Confidentiality
You agree that you will not allow others to use any aspect of your Account Information. You have responsibility for taking steps to maintain the confidentiality and security of your account. You agree to notify UrFilez immediately of any unauthorized use of your account or password, or any other breach of security. UrFilez will not be responsible for any losses arising out of the unauthorized use of your name, password and/or account and you agree to indemnify and hold harmless UrFilez, its partners, parents, subsidiaries, agents, affiliates and/or licensors, as applicable, for any improper, unauthorized or illegal uses of the same.

UrFilez cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.

3. Security
To prevent unauthorized access, to maintain data accuracy, and to ensure the appropriate use of Account Information, UrFilez uses appropriate physical, technical and administrative procedures to safeguard the information we collect. We use Secure Sockets Layer (SSL) encryption when collecting or transferring sensitive data such as credit card information. SSL encryption is designed to make the information unreadable by anyone but us. However, you understand that transmissions are never completely private or secure and that any message or information you send to us may be read or intercepted by others, even if there is a special notice that a particular transmission is encrypted. Credit card numbers will only be used for processing payments and will not be used for other purposes.

4. License Grant
You are granted a limited, non-exclusive, non-transferable license to make personal non-commercial use of the Mobile Services. If you subscribe to any of the Mobile Services, this license is contingent upon your timely payment of any applicable subscription fees and charges and your compliance with any other terms and conditions applicable to you as a subscriber. Any violation by you of these license provisions may result in the immediate termination of your right to use the Mobile Services. UrFilez reserves all right, title and interest not expressly granted under this license to the fullest extent possible under applicable laws. ANY USE OF THE MOBILE SERVICES NOT SPECIFICALLY PERMITTED UNDER THESE MOBILE TERMS IS STRICTLY PROHIBITED.

5. Content
All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code (collectively, “Content”), including but not limited to the design, structure, selection, coordination, expression, “look and feel” and arrangement of such content contained in the Mobile Services is owned, controlled or licensed by or to UrFilez, and is protected by trade dress, copyright, patent and trademark laws, and various other intellectual property rights and unfair competition laws. Except as expressly provided in these Mobile Terms, no part of the Mobile Services and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including “mirroring”) to any other computer, server, website or other medium for publication or distribution or for any commercial enterprise, without UrFilez’s express prior written consent.

6. Restrictions of use
You agree that you will not: 1) copy, reproduce, record, make available to the public or otherwise use any part of the Mobile Services or the Content in a manner not expressly permitted under these Mobile Terms or the UrFilez Terms and Conditions of Use;
2) provide your Account Information to any other person or use any other person’s Account Information;
3) attempt to gain unauthorized access to any portion or feature of the Mobile Services, or any other systems or networks connected to the Mobile Services, or to any of the services offered on or through the Mobile Services, by hacking, password "mining" or any other illegitimate means;
4) reverse engineer, decompile, disassemble, modify or create derivative works based on the Mobile Services or the Content or any part thereof;
5) probe, scan, or test the vulnerability of the Mobile Services or any network connected to the Mobile Services, nor,breach the security or authentication measures used by UrFilez, its licensors, or any third party to protect content accessible through the Mobile Services or through any network connected to the Mobile Services;
6) rent, assign, lease, or sublicense any part of the Mobile Services or use the Mobile Services for any commercial use;
7) circumvent any territorial restrictions applied by UrFilez;
8) artificially increase play count or otherwise manipulate the Mobile Services by using a script or other automated process; or
9) use the Mobile Services or Content for any purpose that is unlawful or in any way violates these Mobile Terms or the UrFilez Terms and Conditions of Use.
In addition to the above, you agree to take all reasonable care to prevent unauthorized use of the Mobile Services and its Content.
7. Prices
Where any subscription package or products or services offered on the Mobile Services are offered free of charge, UrFilez reserves the right, in its absolute discretion, to modify or withdraw such subscription package, products, or services at any time without prior notice and with no liability. UrFilez also reserves the right, in its absolute discretion and with no liability, to begin charging for such subscription package, products or services. You will be notified if UrFilez exercises its right to begin charging you, and you will have the option to terminate your subscription of the Mobile Services in accordance with Paragraph 9 of these Mobile Terms. UrFilez may change the price for any subscription package or to any products or services offered on the Mobile Services from time to time. With respect to any change in the subscription price, such changed price will take effect after the expiry of the then current paid-for period (i.e. the term that you have already paid for). Any price change will be communicated to you. If you do not wish to be bound by such changed price, you may terminate your subscription of the Mobile Services in accordance with Paragraph 9 of these Mobile Terms. Your continued use of the Mobile Services after the communication of such price change to you constitutes an acceptance of such new price.

8. Other Terms and Conditions
Additional terms and conditions may apply to purchases of goods or services and to specific portions or features of the Mobile Services, including contest, promotions or other similar features, all of which terms are made a part of these Mobile Terms by this reference. You agree to abide by such other terms and conditions, including where applicable representing that you are of sufficient legal age to use or participate in such service or feature. If there is a conflict between these Mobile Terms and the terms posted for or applicable to a specific service offered on or through the Mobile Services, the latter terms shall control with respect to your use of that specific service.

9. Payment, Automatic Renewal, Term and Termination
These Mobile Terms will become effective in relation to you when you register for or start using the Mobile Services and will remain in effect until terminated by you or UrFilez.

If you agree to pay for a subscription, you will be charged a fee in accordance with the payment method you have chosen for your purchase. If you are paying by credit or debit card, by designating a card to be billed, you confirm that you are authorized to make such purchase and that you are the holder of such card (i.e. that the card is issued in your name). Your subscription will automatically renew until terminated by you. As such, you will be billed on a periodic basis (e.g., on a monthly basis) until you terminate your subscription. You may cancel your subscription of the Mobile Services at any time by going to Manage Account under the Settings tab of the Mobile Application or by contacting your Telco directly. Any subscription termination shall have effect at the expiry of the then-current subscription period that you have already paid for. UrFilez will not refund any remaining portion of subscription fees you have already paid for.

UrFilez reserves the right to suspend your account at any time in case of unauthorized, or suspected unauthorized use of the Mobile Services, whether in contravention of these Mobile Terms or otherwise. If UrFilez suspends your account for any reason, UrFilez shall have no liability or responsibility to you, and UrFilez will not refund any amounts that you have previously paid.

10. Disclaimers
USE OF THE MOBILE SERVICES (INCLUDING BUT NOT LIMITED TO ITS CONTENT AND ANY SOFTWARE CONTAINED THEREIN) IS AT YOUR OWN RISK. THE MOBILE SERVICES IS PROVIDED AND LICENSED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT POSSIBLE UNDER APPLICABLE LAW, URFILEZ DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. URFILEZ MAKES NO REPRESENTATIONS OR GUARANTEES THAT THE MOBILE SERVICES WILL BE FREE FROM LOSS, DESTRUCTION, DAMAGE, CORRUPTION, ATTACK, VIRUSES, INTERFERENCE, HACKING, OR OTHER SECURITY INTRUSION, AND URFILEZ DISCLAIMS ANY LIABILITY RELATING THERETO.

UrFilez will make reasonable efforts to keep the Mobile Services operational. However, certain technical difficulties or maintenance may, from time to time, result in temporary interruptions. URFILEZ MAKES NO GUARANTEES, REPRESENTATIONS OR WARRANTIES THAT USE OR RESULTS OF THE USE OF THE MOBILE SERVICES WILL BE ACCURATE, RELIABLE, CURRENT, UNINTERRUPTED OR WITHOUT ERRORS. WITHOUT PRIOR NOTICE, URFILEZ MAY MODIFY, SUSPEND OR DISCONTINUE THE MOBILE SERVICES (INCLUDING ANY CONTENT) OR YOUR USE OF THEM. WHENEVER URFILEZ ELECTS TO MODIFY, SUSPEND OR DISCONTINUE THE MOBILE SERVICES, IT WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTY.

YOU ACKNOWLEDGE THAT YOUR SUBMISSION OF ANY INFORMATION TO US IS AT YOUR OWN RISK. URFILEZ DOES NOT ASSUME ANY LIABILITY TO YOU WITH REGARD TO ANY LOSS OR LIABILITY RELATING TO SUCH INFORMATION IN ANY WAY.

YOU UNDERSTAND THAT YOU MAY ENCOUNTER OFFENSIVE, INDECENT OR OTHER OBJECTIONABLE CONTENT WHEN USING THE MOBILE SERVICES. URFILEZ WILL HAVE NO LIABILITY TO YOU FOR ANY SUCH CONTENT.

Some of the content, products and services available through the Mobile Services may include materials, including but not limited to, links to websites or advertisements that belong to third parties and are not under the control of UrFilez. YOU ACKNOWLEDGE THAT URFILEZ DOES NOT WARRANT, ENDORSE, GUARANTEE OR ASSUME RESPONSIBILITY FOR ANY SUCH MATERIALS, AND THAT URFILEZ SHALL HAVE NO LIABILITY TO YOU FOR ANY FAILURE TO GIVE NOTICE OF THE POSSIBLE CONTENTS OR SUBJECT MATTER OF SUCH MATERIALS. UrFilez will in no way be responsible for any transaction between you and third party providers of products or services advertised on or through the Mobile Services. As with any purchase of a product or service through any medium or in any environment, you should use your judgment and exercise caution where appropriate. No advice or information, whether oral or in writing obtained by you from UrFilez shall create any warranty on behalf of UrFilez in this regard.

11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL URFILEZ, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, GENERAL, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES (INCLUDING BUT NOT LIMITED TO ANY LOSS OF PROFITS, BUSINESS INTERRUPTION, CORRUPTION OF FILES, LOSS OF BUSINESS INFORMATION, LOSS OF DATA, SERVICE INTERRUPTION, COMPUTER FAILURE OR PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE MOBILE SERVICES (INCLUDING BUT NOT LIMITED TO ITS CONTENT), EVEN IF URFILEZ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY URFILEZ OR OTHERS WILL CREATE A WARRANTY AND NEITHER YOU NOR ANY THIRD PARTY MAY RELY ON ANY SUCH INFORMATION OR ADVICE.

Your only right with respect to any problems or dissatisfaction with the Mobile Services is to uninstall the Mobile Application and to stop using the Mobile Services. In no event will UrFilez’s total liability to you in connection with these Mobile Terms exceed the greater of one dollar (U.S. $1.00) or the total amount paid by you for the Mobile Services.

12. Indemnity
YOU AGREE TO INDEMNIFY AND HOLD URFILEZ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS AND LICENSORS HARMLESS FROM ANY CLAIM OR DEMAND (INCLUDING BUT NOT LIMITED TO REASONABLE LEGAL FEES) MADE AGAINST URFILEZ BY ANY THIRD PARTY DUE TO OR ARISING OUT OF OR RELATED TO YOUR VIOLATION OF THE TERMS AND CONDITIONS OF THESE MOBILE TERMS OR YOUR VIOLATION OF ANY LAWS, REGULATIONS OR THIRD PARTY RIGHTS.

13. Other Information
UrFilez may assign all or any part of these Mobile Terms without restrictions. You may not assign these Mobile Terms to a third party without the prior written consent of UrFilez.
IN ADDITION TO ANY SUBSCRIPTION FEES OR CHARGES, ADDITIONAL DATA CHARGES MAY APPLY FOR CERTAIN TELCOS DEPENDING ON YOUR DATA PLAN.

These Mobile Terms, together with the UrFilez Terms and Conditions of Use and the UrFilez Privacy Policy, constitute all the terms and conditions agreed upon between you and UrFilez and supersede any prior agreements, whether written or oral. Any additional or different terms or conditions in any written or oral communication from you to UrFilez are void. You agree that you have not accepted the terms and conditions of these Mobile Terms in reliance of or due to any oral or written representations made by UrFilez not contained in these Mobile Terms.

Should for any reason or to any extent any provision of these Mobile Terms be held invalid or unenforceable, such invalidity or enforceability shall not in any manner affect or render invalid or unenforceable the remaining provisions of these Mobile Terms and the application of that provision shall be enforced to the extent permitted by law.
These Mobile Terms shall be governed and construed in accordance with the laws of the country of your residence. Any dispute, controversy or claim arising out of or in connection with these Mobile Terms will be subject to the non-exclusive jurisdiction of the court or other tribunal closest to your home with the appropriate knowledge and expertise to deal with such dispute, controversy or claim.

In the event that these Mobile Terms are translated into other languages and there is a discrepancy between the two language versions, the English language version shall prevail to the extent that such discrepancy is the result of an error in translation.
